March 2, 2015—Three-C Body Shops Inc., a four-location multi-shop operation in Ohio, announced on Monday that it has filed suit on behalf of a customer against the at-fault driver in the customer’s accident and Allstate, alleging underpayment on the repair of the customer’s vehicle.
The complaint was filed in the Municipal Court of Franklin County in Ohio against Caleb Brickey, alleging that Brickey’s insurer (Allstate) failed to provide a Three-C Body Shops’ customer full payment for charges for processes and materials.
The issues stemmed from an auto accident in which the at-fault party, Brickey, was negligent and admitted liability for damages to the customer’s 2005 Jeep Liberty.
The final cost of the authorized repair was $5,687.83 and Allstate tendered a payment of $3,585.43, a difference of $2,102.40.
The lawsuit seeks full payment to Three-C Body Shops of the difference plus costs, expenses, attorney fees, prejudgment and postjudgment interest.
