Sept. 16, 2019—The U.S. 9th Circuit Court of Appeals declined Friday to approve a class-action settlement, according to a report by The Detroit Free Press.

The Court declined to approve a settlement between Ford and nearly 2 million owners and former owners of Focus and Fiesta vehicles with defective dual-clutch transmissions. The vehicles have a history of costly repair for failing clutches and other problems.

Public Citizen, a nonprofit consumer advocacy group, challenged how much money would be awarded to consumers. The Court declined to approve the settlement after the group challenged the decision.

The terms of the settlement will go back to the U.S. district court.
