Pa. Shop to Pay Back Wages to Settle a Complaint

A prominent auto paint and collision shop in Ellwood City, Pa., has paid $67,462 in back pay and damages to some of its workers.

October 4, 2018—A body shop in Ellwood City has paid back wages and damages to 12 workers to settle a federal Department of Labor complaint, reported Ellwood City Ledger.

The U.S. Department of Labor released a statement Thursday saying it conducted an investigation into Boehm Family Enterprises LLC, doing business as McElwain Brothers Paint and Collision in Ellwood City, and determined it had violated the Fair Labor Standards Act when it came to overtime work by 12 mechanics and painters, according to the report.

The department found that the shop incorrectly classified the workers as exempt from the law’s overtime requirements and only paid them straight time when they worked more than 40 hours in a work week. Also, the company failed to include employee performance bonuses when determining overtime pay, the department said.

The shop has paid over $67,000 in back pay and damages.
