Florida shop takes State Farm fight to Supreme Court

July 7, 2011—Gunder’s Auto Center recently announced it has filed an appeal with the U.S. Supreme Court, extending the shop’s slander and tortious interference case against State Farm.

In April, Gunder’s Auto Center received notice that the 11th U.S. Circuit Court of Appeals upheld a lower court’s judgment in favor of State Farm.

“After considerable thought, counsel and discussion with family and close friends, and as a result of recent activities on other pending cases against State Farm, I decided to proceed with submitting what is referred to as a Petition for Writ of Certiorari to the U.S. Supreme Court requesting their review and opinion of the lower court’s ruling,” said Ray Gunder, owner of Gunder’s Auto Center in Lakeland, Fla. “We’re too close to quit now, and will continue until we either prevail or exhaust all opportunities to do so.”

Gunder said his fight is not just about his shop and customers, or just about State Farm. He said he’s doing it for repairers and customers throughout the U.S. who have faced similar issues.

A fund has been set up to provide financial assistance to Gunder’s Auto Center during its lengthy lawsuit against State Farm. The Collision Industry Legal Fund, as it is called, recently received a $2,500 check from an unnamed donor.

Gunder said he was grateful for the financial support he’s received from people he doesn’t know from across the county. The donations have encouraged him to continue the lawsuit, he said.
