N.C. Shop Wins Short-Pay Suit Against Allstate

June 9, 2014—A suit against Allstate Insurance Co. from a North Carolina collision repair shop was successfully arbitrated Friday, resulting in a win for Ronnie Pack, owner of Pack Brothers Collision Center Inc.

The court documents, obtained by FenderBender, note that Allstate failed to pay the full amount of the cost of repair to Pack Brothers, while also failing to provide a reason for the short-pay or offering an alternative amount for the work.

Allstate was required to pay three times the $891.72 that was left unpaid for the nearly $3,500 repair to its client’s 2012 Dodge Ram 3500 4x4 Mega Laramie. Damages were tripled because of the insurance company’s “breach of contract, bad faith by insurance company and unfair and deceptive practices,” according to a press release.

Allstate was also required to reimburse Pack for legal costs totalling $900, according to the arbitration documents. In full, Pack received $3,575.16 for the suit.
