Feb. 20, 2012—The Automotive Service Association (ASA) recently expressed support of legislation proposed in Michigan to increase tort liability within the state’s no-fault insurance system.
The proposed legislation—H.B. 5362, which was introduced by Rep. Cindy Denby—would amend section 3e of MCL 500.3135. The legislation would raise Michigan’s tort liability from $500 to $1,000, according to the ASA.
The ASA said that tort liability has not been raised in Michigan since the 1990s. But this proposed increase would treat consumers more fairly.
This is a “realistic figure in accordance to consumer price indexing,” said Ray Fisher, president of ASA-Michigan. He added that the liability fee has not been abused, and the current amount of $500 is unrealistic for today.
The ASA is advocating for Michigan repair shop owners to support the proposed bill by sending letters of support to their legislators through the organization’s legislative website, TakingTheHill.com.
